pls pls help me!! about A# pls....!

What should I do?

  • Try to get an Emergency AP- and then maybe they'll assign me an A#

I got married to a US citizen, he sent the I-130 to Laguna Niguel and then I found out I could have applied for Adjustment of Status together with the I-130.

I got the receipt notice letter for the I-130 from Laguna Niguel and I sent Laguna Niguel a letter asking them to send my I-130 to the local office in Santa Ana. At the same time I sent all my Adjustment of status forms to the Santa Ana office with a copy of everything that was sent to Laguna Niguel.

My Question is- did I do o.k.? or should have I waited until I got a notice that my I-130 was transferred to Santa Ana office before sending all the Adjustment of status forms to Santa Ana?

And the other issue is- I want to go to a community college in the spring- so I have until January 10th to apply, but they asked for my A#. Which I don't have. There is no A# on the I-130 receipt I got.

I went today to the local office in Santa Ana and the officer there told me I will only get an A# once my I-485 is approved (within 8 months) or when I get my EAD (which takes 90 days)... I do not have that much time!! I asked him maybe he or anybody can sign a letter stating that I'm applying for AOS and he said there is nothing I can do. I told him that I read online that sometimes immigration put an A# on the back of the cheques after they cash them... is that true? will Santa Ana office wait for my I-130 to be transferred from Laguna Niguel and only then cash my cheques or will the cash it now?

In conclusion, the Santa Ana office weren't very helpful....

I called immigration again and the supervisor on the phone told me I should write a letter to USCIS attention: district director

And describing my problem...

I thought if I won't find an A# on my cheques like within a month I'll try applying for emergency EP hoping they'll aprove it and write an A# on it...

You get an A# straight after INS receive your application. You are assigned one immediately and it will be also written on the receipt notices you get from INS that you AOS kit has been received. I really cant get what that officer was bulls**tting about. You dont wait 1000 years for Alien RN, you get it immidiately with the receipts.
It took me 3 weeks from the day we mailed the AOS docs until I got the receipts from INS. You should get hem by Jan.
Dont worry about the offices. They will forward the docs to the appropriate places. 130 will be at NBC and 485 at Santa Ana.
If there's something wrong that you didnt wait for the RN for 130 they will send you RFE. If not you're fine as long as you attached a copy of it + I think also your husnband's Birth Certificate or NAturalization C.

I even called immigration and they said that the Santa Ana sub office does not provide receipt notices. That’s why I won't have an A#...

did you send your forms to that office?

And what's RFE?

RFE - Request for Further Evidence. You will get a request RFE whenever USCIS need more evidence or information from you.

But here is what I think you are looking for:
OPTION 1: This option is fast only if you have all your paperwork and documents in place for I-485 and the others (EAD and/or AP) you wish to include. You may mail the following along with your I-485 (AOS with EAD or AP if applicable):
* the I-797 (NOA and proof of payment for I-130) of your pending I-130;
* copy of your submitted I-130;
* copy of sponsor's naturalization certificate;
* AR-11: Alien's change of address (if applicable).

Do not cancel you original I-130 with VSC, or else you will have to pay the I-130 fee again. Newark will contact VSC to get the payment and the original I-130 on your behalf.

This will work very well because your I-485 will get the earliest priority date possible.

As for studying. You next option is simply to apply for F1 (student visa) and while the F-1 is pending you can still attend classes. Either way, I think you will need to pay extra as a foreign student.
