I have this problem my conditional GC will expire on 2/20/2011.. then i applied for an expedited reentry permit just this march. I assume i
will have my biometrics done by april then fly to the Philippines right after my bio.. I will finish my course there since school is cheap there... still have 3 more years to go..
1) Now my problem is I have to come back between Nov 20, 2010-Feb 20, 2011 which means stopping school for the second semester or missing 1 month from school since I cant attend my feb-march class anymore. That's kinda hard to do because If I stop for that semester, I'm going to stop for the whole year again and wait for the semester I've stopped school that is due to the availability of subjects offered in that semester only. I cant proceed to the next year because of the pre-requisite subjects. In order for me to continue my school and not stop, Im planning to go back to US maybe for a week on Nov. 21, 2010 to apply for the removal of conditions then go back to the Philippines again. When my husband would receive the letter for biometrics, I assume that would be around December, he would inform me and go back to US again to have my biometrics done. Is this possible? As what i've heard is it really important for me to file I-751 while I'm in the US? or can I just send my husband the packet and have him send it to USCIS? And i will just go to US for the biometrics appointment.. Will the uscis know that Im not in the US by the time I file for the I-751? I will just enter the US again for the biometrics appointment... since it will cost so much money for the fare.. Or can he fill up the forms for me?
2) After filing the I-751 removal of conditions, can i still travel outside the US since my GC is still valid till feb 20, 2011?
3) When I receive the letter after filing the I-751 stating that I have an extension of 1 year, can i now travel without minding the expiration of my GC which is 2/20/2011? Can i disregard my GC's expiration 2/20/2011 since I have the letter which says I have an extension of 1 year?? I know by that time my Reentry Permit is still valid... So I can still continue my studies till March.
4) Will the officers allow me to travel in and out of the US even if my conditional GC is near its expiration date? Like if I travel November 2010, December 2010, January 2011? Or is there a certain time of which I'm not allowed to travel anymore like if I'm in the period of removal of conditions already even if my conditional GC is still valid although near its expiration date? Would the officers at the PoE know that Im on the process of removing the conditions? Or all they care is that my GC is still valid for me to enter the US???
5) My conditional GC will expire first than my reentry permit...Once my conditional GC expires, does that also automatically expire my Reentry Permit? Or my reentry can still be valid until its expiration date? I know i will have the letter by that time (the letter stating the extension of 1 year for my GC). In case my conditional expired already, will I be allowed to enter the US providing my expired GC, notice stating the extension of 1 year and a valid reentry permit?
6) Another question, Is it possible to apply for another reentry permit right after my reentry permit will expire since I'm not done with school by that time. Or can i apply for another reentry permit a month or two before my current reentry permit will expire??? is this possible????
I know that's still 2 years from now but I wanna know ahead of time... So that when that time comes, I know what to do and not panic.
Sorry for the very long post...
But Please help me.. Enlighten me... I don't wanna miss school anymore. I want to finish it badly so that I can work after...
