What is Concurrent Filling? If I-140 is approved (irrespective of Concurrent or Non-Concurrent filling) is INS treat it as Concurrent?

My case is Filed I-140 in July'03 & 485 in Dec'03. Hope this is Non-Concurrent Case. But my I-140 was approved. Waiting for FP.

Please advice me.
 
For anything to be concurrent it has to be with respect to something else.
So 140 is concurrent with 485. Have u applied for 485?
If you have not applied for AOS-485 then no FP is going to be generated.
While applying for 140, you mention that you are going to go for AOS-Adjustment of status using 485 concurrently or Counslar processing-CP.
If you chose AOs and applied for 485, you will be treated concurrent.

I-140
Receipt Dt: 7/27/2003
Approval Date: 4/22/2004

I-485
Receipt Dt: 12/29/2003
Approval Date: -----

Not requested for FP so far. EADs Approved. AP is pending.

I am not sure what my attorney mentioned while filling 485. I am sure it is not Councilor processing.
 
I think your case is concurrent. Please check with your attorney too. You might receive a FP notice in a few months. However, your AP is behind the current processing dates. Check with your attorney about this. Try to be in touch with your attorney and get updates from him. Lot of times attorneys and employers do not want to disclose info. So be always on the cautious side.

I relived from tension after getting clarification from you and from my attorney. I checked up with attorney, they told me my case is concurrent because we filled I-485 before decision take on I-140. Hope my understanding is correct as of now.

Secondly, my AP (Form I-131) was filled on 12/29/2003. At Vermont service center the priority date for this type of case is Dec 10, 2003 (Latest update of April 22, 2004). So I can expect decision on AP in the next couple of weeks. This case on line status showing, as it is in the process....and it will take 30-60 days.....
