Pleese advice ready to adjust status from F1 to permanent res.

well what I need to know is that first of all me and my wife do not reside in the same address as of now we plan to but i am looking to get employed in her state first cos that will be better for us.

My question is on three diffrenet issues

1.how should she file the i-130 ,with diferent addresses for me and her or the same address is better


2.My wife is in school too and is unemployed.Does she still have to file the afidavit of support and if so what do we do with the three years of tax filling requirment that the main sponser has to provide .Please advice on the how to go about this as i am very new to all this.Note that I already have a Joint Sponser who will meet that 125% guidline



3.I am also out of F1 Status bcos of not attending my school(yeah I know thiis sucks and i am not proud of it). My F1 Visa though Is Still Valid For Another year ie. My F1 VISA Expires in 06/2007.

I will like to know if this will be a problem and if it will come up at my interview.Deos any one here have a similar situation or have any knowledge on this kind of situation Please feel free to advice.I am getting ready to put my application package in anytime soon , God willing Sooner.

First have you guys got married? anyways, Since you are out of status and not in deportation I dont think a few weeks here and there will matter much. I know the preasures a student feels in this country. I would highly recommend that when you file your I-130, I485, and I-765 the address on them should be the one your wife stays and where eventuly you will stay.

Great, Both your wife and the joint sponsor should file Aff of support , your joint sponsor will have to fill out I864A with his tax returns.

It dosent matter when the date expires on your F-1. When you enter the states you get D/S, that is duration of stay, so if you drop out of school you have 180 days to leave the country else your visa expires.

Since you are married to USC your overstay will be forgiven, however, yes they will ask you questions why you dropped out and when do you plan to go back etc.
