Please your advise

Hello, I have applied for my citizenship on may 31/2005 then I went to the interview on the 26th of September 2005 and I passed the test after he gave a hard time, But the officer requested more document such as utility bills and my tax return etc.... after a month I called the office of san Antonio and they said that they have received my documents, and my case is pending for a background check, after a week ago I contacted my Congressman who initiated a request on my behalf to the USCIS, I got the answer from him after three days from my request saying that my case is still pending and there is nothing else he can do. So I have been waiting so for over 10 months since I applied and 6 months since the interview.
Please anyone can advise with any kind of contacts to the FBI or USCIS or any kind of help it would be much appreciated especially I have a wife and daughter living overseas and I would like to bring them ASAP.Thank you

Cases pending for over an year for the name check clearance is not uncommon. If you get it sooner then it is a surprise. I know it is very frustrating but that is the reality. Unfortnately some people get sucked into this name check black hole. I have seen few posts on this forum where folks have filed a law suit and they got prompt response from CIS in their favor. You may want to explore that route.

Your file was supposed to be completed with all the required paper work complete.

Is your application based on marriage or employment. Did you have any unusual situation?

yes I came to usa with marriage visa, then me and my X wife went through divorce before I get my my permanent green card, so i had to hire a lawyer then finally I got it.That's the only problem I had before.

I called the FBI customer service and they said that my fingerprint was sent back to INS on July 2005, but the sanantonio citizenship office they insist that they have not received it from the FBI, guys please advise what should I do in the next step.Thanks
 
if anything, two things are quite clear from countless posts here:

a) the USCIS is incompetent at their duties: they don't seem to be organized and are poorly run. and they cannot get their job done with the lowest level of consistency that you would expect from an organization on a $1.8 billion budget. Mind you, 90% of that budget comes from the applicants, you and me. Yet, they treat everyone of us like dirt.
b) the only way to get USCIS to do its job is to file a lawsuit against them, and move your case out of their jurisdication. That has been consistently proven to be an effective way to get any performance out of the USCIS, and the USCIS actually has an internal process to support lawsuits against themselves.

So what else are you waiting for?
 
Please read the threads regarding Finger Print Check and background/name check. They are different.

I would suggest suing USCIS - otherwise you could be in limbo for an indefinite time.

I don't know if the basis for your green card is being looked at. At citizenship stage they look up everything again. Since you got your green card because you were married to USC and then you had problems getting approved due to divorce. You want to make sure that this does not come back to haunt you.

You could do what Suzy did and file again. Money down the drain, but it is an option.

I would suggest writing to the Service Center where you filed first.

Why money down the drain? This month I'm scheduled for the interview...I may get a second Naturalization certificate :D :D :D

On a serious note, I wish I can sue the idiot lawyer who advised me to do that :(

...but what the hell, I'm applying for my parents with no lawyer (because I got mad on him on the Naturalization issue) and he lost at least $2,000 and I've saved at least $2,000...so I'm better off than if I was staying happy with him and had him preparing the papers for my parents

Thanks guys for youR respond.I went yesterday to the Ins office and I tolled them That my case was cleared from the FBI, then they checked it up, after that they said that it's still pending for a background check and they said only fingerprint was cleared from the fbi which is I didn't know the difference between (fP) and (Bg-check) I really was very disappointed, any advise guys on how to get this name check cleared? REGARDS

From your first post it was very clear that your Name Check is not completed. You hoped and wanted to believe that Background Check means FP.

I told you before, I'm saying it again: Read Publicus's thread and if you really want to do something sue them. That's your last and only resort...besides waiting and waiting...
