Hi everybody...My husband is USC and we submitted I485, I765 and I130 in september and had biometrics done today...
They said that in two or three months I will get an EAD... Does it mean that they accepted our petitions or is there any chance that later they tell us something was wrong in the forms???

We got an appointment for interview for February 2005 and they asked for somethings we have to bring...
1. All my passports mean??? ALL of them since I was born??? what happen if I just have the recent one and lost the others??? I left them in my country and have no idea where they could be...
2. Affidavit of support: me submitted it with the whole bunch for I485... do we have to do it again???
3. Medical: the same as 2
4. Joined accounts and properties... I need a SSN to open an account with my husband and they wont give me one until I have an EAD... and besides without EAD I cant work to get enough money to increase my husband's account...
5. Translations: the translations we submitted with the applications were not that accurate (I mean not literally translated). I brought the previous marriage and divorce certificates to the translator and he made it very simple without all the parafernalia used in Latin America... should we ask him to do it again, this time exactly as the paper says???
6. My husband did something similiar for his first wife when he was living in Latin America... but they divorced later and he never asked for a I 485 for her... is this a problem for me to get a GC through him???
7. We submitted all the forms by ourselves... we dont have a lawyer... is it better to hire and bring one to the interview???
8. Is that the real interview to accept or deny our case or just something to check if we have everything in order?

Thanks for your patience... I think i need a lawyer or some legal assessment with all this headaching process...

Hi there,
I see you have a lot of questions. I will answer only one for you. Don't get a lawyer. You don't really need one. Once everthing is ok with your paper work you should not have any problem. Getting a lawyer will not speed or make anything better. It is better to do it for on your own.

Only the passport you came with here in the USA. I've never heard of somebody holding 2 international passports at one at the same time (exceps seamen who are requred to have a second passport)
2. Affidavit of support: me submitted it with the whole bunch for I485... do we have to do it again???
Yes if the information has changed. Let's say - your husband swithed employers. If everything's the same - there's no need
3. Medical: the same as 2 = NO
4. Joined accounts and properties... I need a SSN to open an account with my husband and they wont give me one until I have an EAD... and besides without EAD I cant work to get enough money to increase my husband's account...It's self undersatnadalble that your husband cant put your name anywhere because every authority wants your SSN and there's no way for you to have it at the time being. In your case it's not fatal.
5. Translations: the translations we submitted with the applications were not that accurate (I mean not literally translated). I brought the previous marriage and divorce certificates to the translator and he made it very simple without all the parafernalia used in Latin America... should we ask him to do it again, this time exactly as the paper says??? -I know that the law requires a translation of foreign documents by a certified translator. I see other guys here follow the procedure "DO it yourself!!!!" so I really cant tell you. I myself had all my papers done by certified T But if your translator is certified you shouldnt have problems
6. My husband did something similiar for his first wife when he was living in Latin America... but they divorced later and he never asked for a I 485 for her... is this a problem for me to get a GC through him???- It's not a problem to get GC through your hubbie. However as far as I undertsand from your words., he's been married to another foreigner before and went through the same procedure with her. You 'll most likely be questioned about your previous marriages. Since your husband is doing this for second time they will want him to give a genuine proof that he's not entered marriage with monetary motives!!!!
7. We submitted all the forms by ourselves... we dont have a lawyer... is it better to hire and bring one to the interview???- I dont think you need a laweyer. Everything is pretty straight forward exept that "double marriage to alien - experince" of your husband. If that is the case
8. Is that the real interview to accept or deny our case or just something to check if we have everything in order?Cant really tell you, still waiting for it.

Thanks for your patience... I think i need a lawyer or some legal assessment with all this headaching process...

My advice to you is to have your translations NOTARIZED BY A NOTARY PUBLIC. You can find such a person at a Univeristy, bank, law office, etc.

My husband is Russian. We had a Russian University professor translate his birth certificate into English and then we had it notarized at the University Presiden'ts office.

Kiska

Thanks

Thanks to all for your answers... I am really enjoying this experience, not because it is funny but because your support... I hope everything goes OK to me, so I can start helping others too...
The translations is supposed to be certified and they are also notarized, but they are not accurate... that is the problem, but if things are as you guys said, maybe there will be no problem...
About the previous romance... what can we do??? He has to say that he loves me!!!
Thanks again.

You'll be fine. Get more reasonable explanations about his double experience in marriage though. As far the translations are concerned I can tell you my experience. I had them translated by a certified translator, notariezed and stamped by the Ministry of Foreign Affairs (apostille obtained) in my country. And copies of all those notariezed here again. This is the way foreign docs are in general made valid worldwide if the country is a part of the Hague Convention:
http://www.scsos.com/hagueconv.htm (These are the participating parties).
That's why I had to have and my US - Marriage Certificate issued heredone that way (obtained an apostille by the Commonwealth of the State), because my country wont accept it's validity without an apostille and will still consider me single no matter that I am married in a foreign country.
However not everybody does that and simple certified translation and notarization should do. As long as the translation can tell what is to be understood from the document you should be fine.
Good luck!

Could you please share your time frame like Receipt date, notice date, FP, Local office etc with us? Good luck.

about us

We prepared all the papers without a lawyer and send them to NYC office on October 12. Got received notice on Oct 28 for I 485 and I 765. Call for biometrics and have them done on Nov 26. In Nov 14th we got the interview letter for February the 7th in NYC.
Now we have to prepare psychologically for that... they asked for family pictures and joined stuff and so far we have none of them...
I want to know if it is advisable to apply for an advance parole now or wait until February to ask for one??? We didnt do that before for several reasons but I think I will need one soon... thanks
