Hi.
I am a Canadian citizen, currently working in US on H1B (commuting every day from Canada to US and back). I also have an opportunity to work on a large project with 2 other guys (US citizens). Those 2 guys have a registered company. They could offer me a partnership (I would get a percentage from a company's profit). I know, that legally I can't work with those guys until I'll get my Green Card, which is in process (just started the process, so I have a LONG way to go).
So, is it possible for me to open a consulting company in Canada, be an owner and the only employee of this company, so those 2 guys (as a US company) would hire my company in Canada for a consulting services, and for those services pay not directly to me, but to my company. I would work, let's say, at home, in Canada and get my money from MY company, as an employee. So, technically I would be working not for US company, but for MY Canadian company.
So, is it at all possible ? Is it LEGAL to do that ? What would your suggestion be ?

As long as all the work for your canadian company which is a vendor of the main US company is done in Canada, INS will stay out. This work around sounds like the best option you ahve to be teh working partner of the firm. Good luck with your enterprise!

Yes, all the work will be done in Canada, and I guess, even all communication and data exchange will be done through the Email and VPN.
