hi, i came to the US on visitors. Got H1B1 approved while in US. But before the approval came thro\', my visitor visa expired. So technically was out of status for 2 days.
My wife is in India. She went for H4 but the consulate insists on H1 stamped on my passport.
Now since there r no guarantees to get my visa stamped in Canada..and i dont think it is possible to come back to US on just I94 without a visa.
Only option is to apply for Canadian PR.
My dilemma is if i get thro with Canadian PR, I know i can enter US on just a valid I94 but does my wife need a visa to US? will it be a problem to get a visitors visa from canada if she is a Permanent Resident there? Or is it possible for her to enter US rt now on visitors from Canada?
Please people, guide me. My family needs to come here soon and rt now i dont see how?

from what i have heard, you should not be \'technically\' out of status in US .. as your application was \'in process\' .. you might want to consider a trip to india and get your/ your spouse\'s visa stamped. You coy\'s imm lawyer should be able to give you a expert opinion on thsi route..
