Please reply if you know. I got favorable recommendation from DOS. Now how much time this will take to get final approval from USCIS and are there any chances for denial?

According to webpage the Vermont center is dealing cases until March 20, 2006. I looked the Vermont center processing times and read the following" I-612: Application for Waiver of the Foreign Residence Requirement: Application for a waiver of the 2-year foreign residence requirement based on exceptional hardship or persecution: March 20, 2006"

My question is that this statment mentions the processing for cases based on exceptional hardship or persecution. Are the cases based on NO OBJECTION dealt in the same way or they take less time?

First of all I haven't gone through my waiver yet, planning to do so in the upcoming few days...(No objection, USAID funds but very old-89 to 94)- I have a post on the subject.???

But based on my reading, understanding, duscussions with others you should be fine.

Once you receive the favorable REC from DOS you're on your way. the USCIS may take few more weeks but usually not too long (may be a month or so at most). Usually the USCIS never goes againts the DOS, I see no reason for that especially when the DOS is really what determines the case in the first place.


So my advice is do not panic/worry, congrats..., just be patient..check the status often but do not get frustarted, that is the US immigration, slow, expensive, frustrating..unless you're illegal :D ...


Just to be ready, and in case this goes on for long (say like more than 2 months), then I would call them (your respective Serv. center) and check. I heard in some instances papers get lost (very remote). If that happens call the DOS and have them send their rec. to USCIS again. But hope that is not the case.

FYI, you can start whatever application (GC, H1, Work, others, etc...) now based on the DOS favoable rec. without waiting, ,but eventually you'l need the USCIS approval.

Don't worry too much about your waiver. Once your case is recommended by DOS then you will get most likely your waiver from USCIS. sometimes it might take little time (say a month)
