Hi,

Please somebody help me if you have come across my situation.

I have filed my I-140 and opted for CP but sometime late april-2004 I also filed my I-485(bcz of the advise from my company). Luckily, my I-140 was also approved at the same time I filed my I-485.

My marriage was sometime in late Jan-2004. To include my wife's name also for CP, I have sent the required info. to NVC. But NVC said you have to contact USCIS bcz you also filed I-485. Now I am planning to send a letter to USCIS to withdraw I-485 and send a notification to NVC to continue my CP. Will it affect my CP in anyway?

I have another concern about my company name change which is going to take effect sometime Oct-2004. Will this also affect my CP?

{Now that your case is in 485 line, you can bring that back to CP process
only by filing Form I-824.

I believe it takes anything like a year for this form to be approved and
for your case to come back to CP route. However based on the consulate
you belong to, it may be possible to adopt a different strategy called
AC 140.

Research the forum for information on this subject by using some key
words}

If your case belong to Mumbai consulate then you can apply AC140 based on I-824 recipt as Raju said, I am not sure about other places.

Received some other info. from my lawyer

Hi,

Thanks for both of you.

Today I received a mail from my lawyer, saying that NVC created a case number for my wife and asked to pay the money. But unfortunately, my wife's name was reversed. So my lawyer sent an another notice to NVC to do the correction and send back the changed notice.

1. Based on the above info., I still have a fear that will these changes will affect my greencard interview in Chennai?
2.If I get back a response from NVC probably after couple of weeks, when can i expect my interview date?
2. Do i need to withdraw my I-485 now?


As per Raju's reply, Do I still need to file I-484? Because I opted for CP when I was filing my I-140 itself.
