My employement based 485 case (in virginia):

First FP Mar 2002
My first FP has expired for 9 months, and RFE response has been pending for 8 months, so I faxed vermont center, which triggers my second FP. It is scheduled on 4/13/2004. I went to local office and get it done on 3/2/2004. Meanwhile, my lawyer sent another fax to ask for expeditious handling, it is rejected with the following reason: "The processing of your petition has been delayed, All petitions received by this service are required to have routine security checkes that are resulting in delays of the adjudication o the petitions. As a result of the lack of manpower to complete the checks in a timely manner, we have no control onver how long these checkes will take. We can give no definite indication of when they will be completed. We apologize for the delay. ". All craps.
Since the rejection letter is sent to my lawyer at roughly the same time I went to get second FP done. I am not sure whether the routine security checkes mentioned in the letter is actually the finger print. If it is, then it is already done. Could anyone clarify for me?
I plan to send another fax to notify vermont my second FP is done and urge them to go ahead to approve my case, but I am not sure whether I should wait until the scheduled time for second FP: 4/13/2004 to send the fax. Any suggestions?
