please look at my desperate case, and give suggestions.

My employement based 485 case (in virginia):
RD Jan 11 2002.
RFE June, 2003
RFE response July 2003
First FP Mar 2002

My first FP has expired for 9 months, and RFE response has been pending for 8 months, so I faxed vermont center, which triggers my second FP. It is scheduled on 4/13/2004. I went to local office and get it done on 3/2/2004. Meanwhile, my lawyer sent another fax to ask for expeditious handling, it is rejected with the following reason: "The processing of your petition has been delayed, All petitions received by this service are required to have routine security checkes that are resulting in delays of the adjudication o the petitions. As a result of the lack of manpower to complete the checks in a timely manner, we have no control onver how long these checkes will take. We can give no definite indication of when they will be completed. We apologize for the delay. ". All craps.
Since the rejection letter is sent to my lawyer at roughly the same time I went to get second FP done. I am not sure whether the routine security checkes mentioned in the letter is actually the finger print. If it is, then it is already done. Could anyone clarify for me?
I plan to send another fax to notify vermont my second FP is done and urge them to go ahead to approve my case, but I am not sure whether I should wait until the scheduled time for second FP: 4/13/2004 to send the fax. Any suggestions?

The routine check is just crap. However, after second FP, you'll hear something(if you are lucky) in 1 to 4 months. My case get assigned to an officer two months after I did 2nd fp, then it took another 2 months for the officer to send me a RFE. :( It's slow, but what can you do? It's just bad luck.

If your receipt date is after Jan, 15th, and can't provide proof on how vermont eats its word regarding to your case, don't bother to send one, since your request will most likely get rejected.
 
jianminglinc, not sure why your situation is a desperate one. Your RD is Jan 11 2002 and there are still many before your RD date. True, we all are suffering because of the unreasoble and unjust processing delay. But try not to be desperate and keep patience. In the mean time try all you can by contacting BCIS or others who might help. Hope you get approval soon.
 
Not to be rude, there are so many people still waiting from 2001, how can you act so desperate when being a 02 filer, mine was Oct-01 case and was approved last month, so just relax, the bright side is that there are many people before u still waiting and some of them have not even received any RFE so far...

I am sorry I brought bad atmosphere in. I am still positive and patient in the waiting. But before I saw your post, I really thought there are only few before me that are not approved. All my coworkers who applied along with me have been approved last year. Now it seems like they are just all very lucky. Best Wishes to all of your approvals.
