Hi Friends,

I am currently working with a Company A. My H1 transfer from previous company to current company i.e. A was approved a week ago.

Now i want to join another company since i have issues with the current employer. Now the current employer is stating that if i quit them they are not going to issue copy of H1 B approval notice which was filed by them.

In this situation if i want to go for another company how safe is it to file the H1 transfer without the approval notice (though it was approved in BCIS records)?

As my current employer says if any time i quit the company i cannot get the approval notice from them. What should i do in this situation?

What will be the possible risk and what is the % of the risk involved? Will it be considered as a new H1 and i will have to go to consulate?

Is there a way to get the copy of I-797 and I-94 from BCIS even if the current employer is not willing to release the documents?

get that in writing by e-mail or

record the phone conv and sue them.. I don't know when these desi companies will learn..!!
 
Just write

or fax them an official letter saying that since you are contemplating a job move you want your approval notice. As them to fax it you ASAP. See what they can reply. I dont think they can refuse you in B/W.
 
I think it is your right to have h1 b approval. Send a certified mail and have a copy of it. If you do that they have to respond to you so way or other way.

Keep copies of every thing you do.

Did any one ever got I-797 or I-94 copies from BCIS? Can you shed some light on this? My current company almost confirmed saying that they won't issue the approval notice and I-94. Without I-94 i cannot even travel out of US and without approval notice i am scared my new H1 transfer will be through or not?
