Hi guys,

My attorney forgot to specify either CP or AOS on my I-140 petition. I had asked him to opt for CP but he had to screw it up. Now, I'm wondering if I have to file a I-824 with INS to opt for CP ? I have heard I-824 takes forever. I hope I don't have to file a I-824 for AOS ? Is AC-140 an option I could take ? Frankly, I don't trust my lawyer anymore, so AC-140 may not be an option.

Please help guys !!!

Thanks for your response. My I-140 was approved two months ago. I was waiting to hear from NVC for the packet 3 which never came. So, I called them up to see if they had heard of my case and they hadn't. So, I called INS and they said my case was approved. Then I looked at my petition and found nothing was selected for the CP/AOS option. Hence the INS to NVC communication never happenned.

Now my lawyer says (I jsut spoke to him) we'll have to file a I-824 with the INS and go the AC-140 route. Do you think if this is a wise thing to do ?

I should probably take a second opinion from another lawyer :(

Are there any lawyers in the house ?? :)

what is on your I140 approval notice?

If your case has not been sent to NVC, you probably need to do AC 140. You need to make sure that your consulate accepts AC 140 first.

Or you can file AOS instead.
 
me too...

The I-140 approval notice doesn't say anythin' about sending the approval to NVC...is it suppossed to ??

My consulate is Mumbai and from what I heard Mumbai accepts AC140.

I have my fingers crossed at this point :-(

will tell you if your case has been approved for CP and forwarded to NVC.

I haven't seen one for AOS. so I don't know what will be on the notice if approved for AOS.

Why don't you do AOS?
 
if u have ur original I-140 approval notice

and since ur consulate is Mumbai, you have two options

1. AOS
2. AC 140 (which should be significantly faster than AOS)

I have my approval notice and it said that my case has been forwarded to NVC. OK?
