I have received my EAD on May 2001.
No FP notice recived.
 
My H1 is expiring on Jan. 02. I have only used my H1 for the last 3 years.
My lawyer is asking me to file for the H1 extension.
He is saying, in any case my 485 rejects, I will be out of status and he can’t do anything at that point.

Is it true?
Is it possible to apply H1 extension at this stage?

Is anybody on this type of situation?

Yes. It is safer to apply for an H1 extension

I think,Your lawyer is correct.
It is safer to apply for your H1 extension.

If you use your H1, If anything happens to your I-485 application
you would not be out of status.
Also if for any reason you needed to change your job, with an H1
you would easily be able to do an H1 transfer.

It depends on your confidence level. How much is the possibility of your 485 being denied? Your lawyer probably just wants to make more money. In case you want to change job, you can do that with EAD using 180-day rule. Your case is probably already pending more than 180 days.
