Please Help!!

Hello members,

First of all, thank you for reading and answering my concern. I am really appreciated.

I live in China and I was on F1 and graduated from college couple of years ago. When I was in college, I was able to file I-140 (EB3-unskilled worker). And I-140 got approved.

My I-140 got approved when I was still in college and since my visa number was unavailable I had to come back to China. I did not work at all when I was on F1 since the employer filed I-140 for my future employment.

I have couple of questions.

(1) Is my visa number still available? Did I have to stay in the US after graduation?

(2) I majored in physics. But I was filed as a restaurant chief assistant. Is it okay? Will the immigration revoke my file because my degree is not matching with what I filed for?

(3) Let's say my visa number became available. And an interview scheduled in a few days. Will the consular ask me whether I will work for them if I return to the US? What if I don't want to? What if I just want to find another job after I get the green card?

(4) In case my visa number becomes available, how can I travel to the US until I get the actual GC?

1. You need to check the status with the employer who filed Form I-140 if they got any further correspondence from USCIS. They could also inform them that you would want consular processing since you are outside US.
2.When your job profile and terms are okay with you and your employer its should not be a problem/
3.Yes you would have to answer lot many question about your intentions and reason for job acceptance.
4.Maybe your employer could petition for a work visa in the category for which you are eligible.Good luck!
