Hello,
Tomorrow I find out if I win the Dv Lottery,
I need help to know if I do what is the best action to take. My B2 Visa will expire on the 8th of August so I have only 3 weeks to take action........
can I apply for an AOS?
How do I do that?!
I assume it must be lodged before the 8th of August-is that correct?
How do I find out if i'm eligible to Adjust Status?

Also, I am not sure if my educational requirements are sufficient, essentially I have 11 years of formal study in Australia but if I win I am going to go for it anyway because I find it very hard to accept that I could be so close to a GC and not get it as there is no other Visa I am eligible for. Does anyone know if I still have a chance??????

I would love any advice
THANKS!

In your situation, even if you win you aren't eligible for an AOS, because your status expires in August.

If you had status into next year for example, you could have.. but in your case I'd be prepared to fly home.

A B2 is a tourist visa also; and although AoS can be done, it isn't recommended. Should you win, I would go for Consular Processing.

And I believe it requires 12 years of formal education; but if this is 11 in Australia and is equivalent to *completing* High School education (or the Aussie equivalent) then you will qualify.

You are so uninformed, the 2012 fiscal year starts on october 1st, so no one can adjust status, do AOS till then. They are still processing the DV 2011 cases till September 30th 2011.

On a side note, irregardless of your visa expiration date, your I-94 *stamp* date overrides this. So if your stamp also says August, then you wouldn't qualify by default. If your stamp is a later date.. perhaps. But this is also assuming you have a low CN (Case No). Australian CN's tend to run on a different scale, so AU... 1-15 would be considered 'low'.

2012 DV visas are not even processed through Stage I until October 2011.

Sorry, I meant I-94, not Visa, my visa expires in 2014, my I-94 expires in August.
Ok, so they don't process till October 1st, good to know, that's why I asked.

What does a low CN mean? That it would get processed quicker?

Thanks

First you need to win and then you need to make sure if your education matches a U.S highschool degree. If not you can forget the whole thing.
