Guys,
I am planning to go out of the country for a vacation in the month of december, my 485 ND is Dec 00. An RFE has been issued on my case and I am yet to receive it, I have my H1 time left until April 02, I have a EAD(never used it)but never applied for a AP,
1.Can I go out of the country and come back with my H1?
2.What if my 485 gets approved when I am not in the country? do I loose my H1 status the moment 485 is approved?
3.My wife is also planning to go out of the country, and she has a valid AP?

try to get ap..

try to get ap if possible.. I have heard that people whose visa/passport wll expire in 6 months(from the date that they are entering back into US) can have problem getting back into the country..I have just heard abt it so dont take my word on it...my two cents - travel using AP..
