Hi,

My 140 was approved on Sep 24. I am on maternity leave without pay since May. My employer is searching for projects now. I don\'t know when I will be getting the project especially in the current scenario. My employer won\'t pay me if I am not on the project. I just talked to my employer and he told me that he would apply for 485 only when I get the project. But I want to apply for 485 immediately. Any inputs or thoughts will be appreciated. Thank you.
 
Nothing to worry.

Little bit of diplomacy on your part will bring the desired results.
Request him to apply for 485, and EAD. Tell him about the 180 days rule also.
He should agree, as you only need two paychecks to apply for a I-485, and a letter. Once you get your EAD, and you wait for 6 more months with or without a job, you have lot better chances of getting your GC. Work with your boss, or agent in making him agree to apply with just two pay check information.

Which pay stubs should I send while applying for 485 - recent ones, my recent ones are in May 2001? Also what is the type of letter required? Thanks again.

YOu need two recent paystubs and a letter stating you are still employed with him. that\'s all you need. You need to do medical and photos. don\'t waste time, compile your stuff as fast as you can, get two recent pay checks, if that amounts to your own money paid as salary to you should be fine.

Thanks for the reply. I am getting all the documents ready for filing for 485.

Do I have to get only the two recent pay stubs or will I get any query sometime during the 485 stage asking for all the pay stubs and W-2 forms?

Furnish a letter from the employer, that you are employed with the company. Attached two recent paystub, your bank statement. Thats it.
You are good to go.
If they do not adjucate for a period of 180 days, then you do not have to worry. Hope it helps.

i have similar problem. I was laid off months ago but company give me all of support documentation ( letter ). but i don\'t think that i could be able to get paystub from them. now i have my i-140 approved. what do you think i should do? go file with what i have or just give it up?
please help me
 
Talked to my attorney...

I just talked to my attorney. He did not specify any recent pay stubs while applying for 485. Only W-2 and tax forms plus the letter from the employer are needed. By the time you get the EAD card, 6 months would have been over and you will be free to move to a different company.
