Hi,

I just got my EAD application approved but am scared that my company will have lay offs anytime. If I apply for an H1B with a new company , would it affect my current EAD in any way? It has been around 4 months since I filed my I-485.

Hi dgap,

Yes and No.

Your EAD is issued while you are waiting for your I-485 to get approved. It gives you permission to work in the U.S. for 1 year.
If you go to a new job based on your EAD, when you try to renew your EAD, you have furnish all the paperwork. If that is indeed different from 485 application, you will be denied.

On the other hand, your spouse can work anywhere she wants if you are the primary applicant.

You could always find a new job and start a new H1B. You could work at the new company with new company knowing well it is valid for only a year and you would get a H1B within that timeframe.

As per my information, you do not need any company specific papers to get your EAD renewed. You can start working for another employer using your EAD and start your GC once again from the beginning, if you get your new labor and I-140 quickly before your I-485 case is processed, you can amend your existing I-485 petition with your new I-140 and get GC.

Once again, I would like to say that you do not need any company specific papers to get your EAD renewed.

I heard from many people that once you started to use EAD there is no possibility to apply for H1-B. Please prove me wrong!!!
