It about the status of my wife.
My wife came on H4 to US initally. Then she coneverted to H1B through a company, but never got a chance to go to home country to get it stamped on her passport. During this process my GC was started and we eventually got the EAD, AP(EAD, AP for Spouse too). And during this process we did goto outside the country but this time since she didnot have the H1 stamp on her Passport, she used her AP to enter US. Now the question is, is her H1 still valid or not valid, that is she now working on EAD(since she entered the country using AP). I am really confused here.
Could anyone please throw some light in this matter.

If she only use AP returning to US and has never used EAD to work, her H1B is still valid as long as she's working for the same employer.

She no longer has H1 status since she has started using EAD for work.

BTW, entering on AP did NOT have anything to do with this ..... she could've easily continued to work on her H1 after entering on AP -- they are not connected and anyone that tells you otherwise is mistaken :)

But now, she's lost her H1 because of using EAD to work.

I have a question. Did she have any problems entering on AP ? Any questions asked ? Any other documents asked ?

I am currently on H-1 but never got it stamped and have 485 pending- (family based.) I just got AP and EAD today . Am planning to visit out of country next month and return back on AP.

The only documents needed to re-enter using AP are the valid AP and a valid passport.

They don't ask for anything else. If you want to cover all bases, keep a copy of your 485 receipt notice - even that is not needed.
 
Top
