Please help with my GC query

Hi Gurus,

I have applied for GC(labor) through my employer. I was on F1 and now Iam on H1. I have an INS query(I-797) asking for proof of status for my experience. Unfortunately the resume that was submitted to INS is more of a client-tailored resume, showing more of US experience(including my F1 duration).

What are my options in such situation? Is it possible to re-submit my updated resume showing my real experience? Or is there a way to support my experience while I was in school? Please advise.

So, your case is fraud. If you work less than 180 days illegal, you are fine. IF NOT, there is no LAW to protect you since you lied too much.
 
I wouldn't say necessarily. What probably happened is that he wants to use experience gained during school - which might be relevant for an employer but does not count for USCIS purposes since it probably was gained before he got his degree. However in the eyes of USCIS they might be wondering how he got experience without work permit (if that was the case - otherwise show the supporting documentation).....

How can one be gainfully employed while on F1 status ? It sounds to me that this person fudged his resume to include his or her F1 period to widen US experience. Obviously, USCIS is now interested in finding out details of unauthorized employment on F1.

Only option now is to send a new updated resume matching status periods.

Yes, he must update all information, but he may not qualify for the job he applied for. So, all of his paper work will get denied and he will reset everything again (LC will be void since he modified his information. If I140 experience letter was made for those experience, I am not sure how serious it is).

The question is if USCIS could consider this is a fraud case or not. If not, he will be fine to apply again. If yes, it will be hard for him to apply again (need a very good support later to do that)
