I came to the US on a J1 Visa (2 year home return imposed - although I did not take government aid). While here I married a US citizen and we have been married for 7 months. Since J1 visas have the 2 year home residency requirement I can not change my status without being deported because the visa was expired when we married (that's what the lawyer said).
Question:
Do you think it is best for me to return home to Jordan. Then my wife come there and remarry me. Then can she apply at the US embassy in Jordan to speed the process of me returning to the US using a K3 visa. Do we have to remarry over seas or can we use the US marriage? OR should I try to get a tourist visa without telling about the marriage so that I will have a different visa type that is easier to change. OR since the J1 was personally financed not paid by the government, can it be waived.
Any help is greatly appreciated as I do not want to leave my American family for any longer than I have to.
