Hi,

Please help me with a couple of questions in form I - 864.

Context: Applying for Family based Green card; concurrently filing I-765/I-130/I-485; I (beneficiary) am in the US on L1visa; my husband (petitioner) is a US citizen; we live in Miami,Fl

Form I -864, Affidavit of Support
1. [Question 21, “Your Household Size”? For line “c”, “if you are currently married, enter’1’ for your spouse”]
Should my husband enter ‘1’ or ‘0’? If he enters ‘1’, he’ll be double counting me, as I am the one he is sponsoring in this application. If he enters ‘0’, will that be considered ‘wrong’ information?

2. [Question 24, “My current annual household income”] We do not want to use my (beneficiary's) income for the sponsorship (because the source of my income can change after I get permanent residence). Can we omit my present income from the calculation of ‘Total household income’ for this question? Will this be considered ‘wrong’ information?

Here is what we did . For question 21 , you only need to fill in a and b i.e, a is the intending immigrant which is you and b is your husband . Add the totalk and say 2 at the end .

For question 24 , we included my income as well as my husband's even though his income alone would have suffuced. Our reasoning was , if the immigrant is employed and earning , you will have to take your W2s to the interview and your 1040 . We were asked for these in our interview as well. And our undertsnading is , the USCIS doesn't care if you switch companies after you get the GC and the source of your income changes. Your current household income you huband's + yours.

This worked out well for us.
