Hi everyone.

I would like to thank this forum for helping those of us who are lost and do not know what to do next.

I got my citizenship on September and applied for my wife form I-485. My wife, from east Africa, does not have birth certifcate and when she migrated to Australia she was asked to get 3 adult people older than her in Australia to give witness that they know her and her parents and they witness that they know here birthdate. And she was issued australian passport.

We were hopping that her Australian passport could be used in lieu of her BC. but today we got Request for Initial Evidence letter reqeusting "Submit a copy of the applicant's foreign bith certificate issued by the appropraite civil authority"

She does not have the BC and she can not bring any document of birth from the authority as request. Can you please help?

Anticipating your quick response.

Can you please help... more than 100 people ready this within a couple of hours it must be very important topic to many.

You must have some documentation from the country of origin. Either a notarized letter from the Bureau of Births otherwise you're not gonna get any traction.

Perhaps the three older adults notarized statement can be taken to a court in her country and then get some form of court order declaring/confirming her birth and the lack of a birth certificate.

This is not Africa, here we deal with documentation. You have to have some form of OFFICIAL documentation to address this. Now if it was my home country also in Africa, they could produce a genuine birth certificate within 24 hours when a few palms are greased with less than $50.

Your statement She does not have the BC and she can not bring any document of birth from the authority as request will not cut it here brother. When USCIS tells you to jump, you only ask how high, not why unless you want this to drag out. You either provide what they want or keep spinning wheels.

Cheers.

Hi there,

We sent a sworn letter for her birth date from my wife's parents in response to the request on November 2012 and the status have not changed as yet.

"Request for Evidence Response Review
On November 26, 2012, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location."

meanwhile she traveled to overseas with advanced parole for 8 weeks (mid March to mid May 2013)

Is this normal.

we went to InfoPath we also called several time but the only reply we get is you have to wait till we call you.
