Hello Everybody i need a help its very urgent.... I am a US citizen, i got married to a man from india, i sponsored him and i bought him to US. Now he is on a Conditional Green Card. I have been having too many problems now a days. He hicked me out from his house and i came to india. It seems like he used me to come to US. Now i am planning on filing for divorce. I would like to know is there anyway can cancel his green card, or can i do something to bring him to india. Please somebody help me out. No lawyer in india has any kind of idea about this situation. Some one please help.

thank you.

if he is on conditional green card...(within the 2 years of PR)...then just don't apply to remove his conditional Permanent Residence. When he ask for you signature for that form....just say no. His GC will expire and he will have to go back to India.

on a more personal matter, are you using this as a way to get him back or to get back at him? and do you think that a little time off will change things. don't do something that will hurt him and then you change your mind.

If you can patch up its good but if you are convinced that he used you then you should refuse to sign the form to remove his conditional status and he will have to come back. Contact a lawyer in US for that matter, in case you wanna take him to court.

thank you guys. There is no way i want to get back with him. I have decided that. Just wondring if i file for divorce that will not give him a chance to extend his green card or anything right?? That guy is a fraud. He never worked in his life before. He did his MCA in 1998 and as of now he has never worked. I happened to see his resume, in that resume he had written that he worked in US since 1999 in different states, meanwhile he came to US only in Feb.2006. If he get a chance to stay in for another 2 yrs he will say that he had worked for all top companies in US and he will get the best job in India. Hmmm he is a criminal. Anyhow so there is no way i can make him come to india right away right???

Why you have to be in India now and look for a way to bring him to India? Can you come back to US and find a lawyer to solve this issue?

What a stupid thing to suggest you spewing Ninny Ignorator, she Should NOT apply to remove conditions on his GC, Too many people are hurt by intending immigrants taking advantage and using them only for GC she should get out of this absuive relationship before she gets hurt or children are involved.

Talk to an Attorney as soon as you can! You need legal advice

addie like youa always, you prove to be a disgrace. hope your don't pass your inferior genes to your kids. look, there are people that stay in abusive relationships because they don't want to lose the greencard. and the spouse says, "you call the police, you will be deproted." so maybe our friend here will say to her husband that if they don't go back to being a family, no more greencard. or maybe she is the kind that would let it go and let him keep the green card, but she is so angry that she will make sure he loses it tomorrow. addie, so go back where you came from and be stupid there. basura humana.

jersey, i would wait a couple of weeks. if you still feel this way, divorce him and talk to lawyer about it. be strong. don't get manipulated again with some sweet talk. good luck.

Just file for divorce. It'd almost impossible for him to get GreenCard aftger divorce.

I agree, File for divorce ASAP, withdraw your Petition and be done with it before you get hurt or he causes you problems.

Addie_Goodvibes, Where have you been?

How are you? Where have you been? I did not see you post for past few days. Glad to see that your cases are moving as fast as ours.

Well, imo, I'm not sure who is using whom. Sometimes the USC uses green card status as a bait to fish rich guys or good-looking girls. I'm not saying that you're one of them.

Anyway, I hope you do the right thing.

I know a person who went through similar situation. All she did was write a letter to USCIS DO. She was in LA.
DO will immideately stop your husband's case. He will have to come back to India. You need to write a letter explaining this situation to USCIS. Be clear that you want to stop his case and do not wish to sponser him any more.

Good luck and hope things work out for you.

UCIS will have to look into the 'facts' of the issue. Basically it is one person's word against the other. USCIS is well aware of marriages where the immigrant gets married only for GC and also of cases where the USC uses the GC or threat of deportation to subdue the immigrant. In this case it looks like the immigrant already has a conditional green card, if he can prove that his marriage was bonafide he will be given unconditional green card and there is nothing the USC can do and vice versa. simply writing a letter will not be the end of the story.

actually, filing for divorce will not alone prevent from getting his 10 yr. card. The I-751 application states that if it can be proven that you had a bona fide marriage, he's still eligible. He should have to submit documents that show you were together, so if he can't get them things will be more difficult. I'd write a letter to both the service center and local office explaining the situation. I hope everything works out for you...good luck.
