hi,
I came to US in 1999 june with valid visa stamping up to
2001 sept. In 2000 june i changed to another company
with new H1. In 2000 dec i went to china, at POE i didn't
show new h1(as i have valid stamping from old).They gave i-94 up to sep 2001(according to old h1) . After wards
in 2001 i got stamping on my passport for new h1 at st louis.
Now i am planning to go for Cp interview in sept 2002. Now my
lawyer is going to extend my h1 also , he is telling that i have to change i-94 before that. Is it necessary to get correction for i-94
If so how many days it will take average. I want to know whether INS will do that correction.
please help.

Where is the new I-94?

I had my new H1-B stamped 2 months ago. The new I-94 was attached to the bottom of the new I-797 form, which expires the same date as the H-1B. This new I-94 (looks different from the one issued at the POE though) should suppress the old I-94.

If you don't you have one, you may have to have it fixed as per your attorney.

If your current H-1B is valid beyond your trip to China, why bother have it extended now?
