Friends,

I have a friend who is waiting for 485 Approval and his PD will be current on the 1st May. He will be adjusting his spouse as the date will be current on 1st May. My question is that, if he sends the application for his spouse now and INS receives it before 1st May, will it be a problem for him to adjust his spouse. Any information is highly appreciated.

The question is a little confusing. Based on my assumptions on the question, since there not much difference between now and May 1st, you can get all the application materials together and send to INS prior to May 1st. This way once INS receives it probably be May 1st. Even if they receive it prior to May 1, I don\'t think they will reject the application because there not a big gap...

However, your lawyer may not be willing to file (prior to May 1) if he/she follows through INS guidelines. If not willing, he/she is technically right but present the above argument though.
