My 6 years on H1B expires in Dec 2005. My employer filed for my GC in 2003.Until now there is no progress other than the priority date I recd. from the attorney. In this 2 years, the financial strength of the company is gone down. SO I am worried that my GC will get rejected when they start processing it.
hence I am considering switching. Now my questions -
a)Can I even switch at this point since they will give me a 7th year extension based on the fact that my GC was filed before the 5th year.
b)If I can, can I just apply for a new PERM application through a new company and let my old one continue just in case
c)If you are an employer and can help, please respond.
