Please help urgent question

Dear friends:

My wife is being given a approved labor by her company which was approved in EB3 category. here are the questions:

1] Even though labor is EB3 category - can she file for I-140 in EB2 category?

2] What are the processing times these days for I-140 in Atlanta (Vermont Service Center)?

3] Are the dates for filing I-485 current? The lawyer is saying that they are not. Her labor is for Sep 2002.

4] How long is I-485 approval taking these days after filing in that area?

I will really appreciate some help.

Will appreciate if someone can really help - her lawyer would probably file her I-140 in EB3 in 1-2 days and I am trying to get a better understanding if it can be filed in EB2. Appreciate the help. Thank You!
 
You have to file only in Texas Service Center(Since Atlanta falls under TSC).

Since the Labour is EB3,you cannot file under EB2.

Your Attorney is right . The current Priority dates for Retrogressed countries is around April 2002.
