Please help me on this urgent issue.

- I applied for my I485 last year based on employment in Company-A
- I also have an EAD valid until Oct 20'th of this year
- Early this year my company was bought over by Company-B
- Since I had a valid EAD, Company-B did not apply for a new H1 for me.
- Thanks to some bungling by our immigration firm, my renewal EAD was not filed on time. The 90'th day after my EAD receipt date, falls a few days after Oct 20th
- I have not received my EAD yet.
- I had discussed this issue with the HR of my company. They consulted with the immigration firm initially and said I would be out of the payroll starting Oct 21'st until the 90'th date after EAD renewal receipt date (Gap period). On the 91'st date I could go to the local INS office, hopefully get an IEAD and get back on the payroll again.
- But today I got a mail from the attorney, where he claims that it ok for me to continue working during the gap period using the H1B visa from Company-A (Valid until sept 2004). He says that since Company-B bought over Company-A it is an "Accession of Interest" and working based on that visa is legal.

Has anyone gone through a similar experience?
Now I'm confused. My gap period is only 3 days and I am not sure if I should take a big risk by working through this period. Please advice.
