I got arrested for shoplifing in 2002 ($90 purse and dress) and was put on pretrail program and the record has been explunged after class and community services. I filed I-485 in July 2007 (Priority date Dec 05, EB-3).
I didn't tell my attroney this and I replied "NO" on the arrested questionnaire on I-485 and now I regretted it very much (I have the court disposition paper and police report with me).
After I told my attroney, he told me not to worry, he said the USCIS will contact me later if they find out my arrest record and they will request more evidence from me.
Is this the best way to do it? Will they automatically reject my application? Please advise. Now everything is unavailable for EB3 and I don't want to lose this opportunity and refile i-485 when it's opened again (don't know when). I really don't know what to do...
