Hi All,

I am currently in the US on a B1 visa.

My company has applied for a H1.

I have the following questions -

How long does it take to get H1 approved??

If I get my H1 visa before my B1 expires, do I need to go out of the country for stamping? Or, can I continue to work and get the stamping the next time I go to India.

If I need to bring my wife on H4, when can I do that? What are the procedures? Can she get H4 stamping, before I get H1 stamping??

In my personal opinion, there might be a potential problem in your case.

Even if your H1B gets approved(it might be difficult),you may not get the I-94 and you would need to travel to your home country to get your H1B Stamped.There you might face unnecessary questions at the consulate.

Anyway,first get your H1B and then think about your wife's H4.

If you have already started working before your H1B has been approved, then you are in real soup!

if the h1 is approved along with the approval of change of status then you can continue working here without visa stamping and you can do this when you go out next time to india.
if the h1 is approved and not the change of status (i94 not attached) then the approval notice will itself notify you to leave usa and get the visa stamp and enter using h1.
if the h1 is denied after the expiration of B1 then you must leave usa immediately

she can get the h4 visa stamp in india with your h1 approval notice along with other supporting documents. it does not matter whether you currently have or have valid h1 visa stamp in your passport
