Please help, spouse died.

Hi,
I have work permit & waiting for my GC approval, had my fingerprints. The only pending issue is getting GC approval.
My problem is my spouse died last week. This GC was actually applied by him.
Now what will be my status, will I get GC. Also dose any one know how do I apply for social security benefits.

Any help would be appreciated.
 
Sorry to hear the news. If your late spouse was the primary applicant and you are the derivative, your I-485 automatically becomes void after his death. I am not aware of any exception for this kind of situation in EB category. Too bad (law is blind, but sometimes cruel too)!

Please accept my sympathy on the loss of your spouse. I suggest you contact a good immigration lawyer, like Rajiv, to consider your options.

RD:8/6,ND:9/26,FP:01/30/2002 & aproved 08/09/2002.
Just heard sweat voice, that my case is approved.
2 weeks back i called IIO to ask if i have to renew my EAD & AP since they will be expiring in october. Then IIO said i have to hear some thin in 15 days & she asked me to call them again if i did not hear any thin in 15 days & exactly on 15'th day, my case is approved. Best of luck to u all. Also i tried to update status on rupnet & i'll try again.

Though it seems that there is some foul play here, i give you a benefit of doubt (assuming that the previous post in 2002 is posted by your husband and you have married him later and filed green card later). Please remember that people hate liers here.
Now coming to your point, one person has earlier experienced the same situation. She ultimately got the GC. She still visits other forums. you can send her private message .

By going by Satish's assumption, it would be more helpfull for you Dev, if you give more details of your immigration i.e., when did you file RD and ND, FP etc.

But if you are just playing some stupid mind game, then you must apoligise for wasting others valuable time and remove this thread because even in dreams someone should not think something like this to happen........

If you don't reply to this thread in a reasonable time frame then we should all assume that this is somekind of foul play and we should request the moderator to remove this thread and prevent the person from accessing this forum.
