1. If you are lucky it is approx 3 1/2 months at this time. It seems to be getting worse every week though. Was 2 1/2 months in May, became 3 months in July, and now 3 1/2.

2. Your health or that of an immediate relative?

3. Probably unlikely. I need one to attend my brother's wedding but I'm not sure if this qualifies.
 
Try fax inquiry

I don't think on health grounds you can get advance parole, because no genuine doctor advices you to travel outside US when you have health problem. When my father expired, I faxed death certificate given by the hospital and the AP got approved the very next day. Any way I am not sure whether the fax enquiry triggered approval as even otherwise it was due for approval. You need to explain what constitutes emergency for you in the form.
 
While there is a chance to get an Emergency Advance Parole based on AOS applicant's health grounds (say, a particular illness that can be addressed only in a particular medical institution abroad), such an issue should be approached very cautiously. Specifically, those health grounds can make one ineligible for adjusting their status. Remember filing your health examination report with the I-485?
 
Does travel on Company business constitute an emergency? I need to travel on business next month and have not received my AP approval yet(WAC-03-173-xxxxx_

Another question while we are on this topic. Last year i re-entered US as a Parolee using my Advanced Parole which has now expired. However I continued to work on H1-B based on Approval notice(I do not have a valid H1-B stamp in my passport). If I depart US next month before I get my AP approval,

1)Will my I-485 application be considered as abandoned?
2)Or can I depart and return after getting a H1-B stamp in India?. Is this valid since I returned once using Advanced Parole.

Please note that I have never used EAD to work(my wife has but she is not travelling with me this time)

Hi,

I am reading the replies sent by all. whatever info I have ..I think you can get a emergency AP generally on health ground. Ideally it should not be your case but your family members... So I think if you have a death in the family OR you can prove that your immidiate relative is very sick..they will give the AP...

I also might need an emergency AP next mth since its been 3 mths in CSC. I was thinking of getting a fake letter from India about my fathers illness and take a chance...I know its not good to lie but what to do man....

Only those medical issues that affect public health and safety are of concern for AOS. THis included all comminucable diseases like TB, HIV, etc. For example if you have a serious heart condition AOS cannot be denied solely because of that.

Emergency AP is not as difficult to get as it is made out to be, usually if you have a good enough reason and can explain the situation to the officer you will be issued on ASAP. It is not your fault that you haven't received your AP on time, if INS bungles their end of the bargain, and doesn't process your application is time, your life still has to go on. Most of the time they understand that and will give you an eAP if you want one, and have applied for a regular AP well in advance.

I suggest you try the honest method first, and say you need to go to India for a marriage/upcoming family get together, etc. And prove the fact that you applied 3-4 months prior to this date but haven't received it yet. You shouldn't have any problems.
 
does not help

i had a similar situation 2 months ago. my advance parole application had been pending for over 3 months. my mother was seriously ill and i even got a letter faxed by a doctor in india stating that she was in her deathbed. well, it did not help! they said all they can do is request the officer to expedite. it took 30 days after that to get the approval.

from my experience, the only "emergency" they consider is the death of an immediate family member (parents or siblings). "seriously ill" does not qualify :(
