Hi,
My fiance is currently on OPT, expiring February, 2005. He was offered a job as a professor at the university and needs to apply for the H1B. Do you think he has enough time for regular processing till his OPT expires or they should do premium processing? Also, as far as I know, applicants, who will be employed at a higher education institutions don't have a cap, right?
Please, please, respond.

yes if his University apply now for regular processing he should be ok it will take usually 3-4 month for regular processing.

Once your h1b application is received its covered under quota but for University there is no such quota.

3-4 months? That's great news. I've been seing 7-8 months or longer in the forum, that's why I was concerned.
Thanks for your quick response.

But I think it is better to apply for Premiere (or is it premium) processing. This way you do not have to worry at all. The times they give can change so do not depend too much on these published dates. One RFE can change the whole thing.

File now under regular processing and see how the case moves. If it gets closer to the deadline, pay the extra $1000 and convert the case to Premium Processing. You might save $1000 this way.
