Hello,

How would be a employment letter for NIW purpose look like? Could someone share a sample or provide some points that must be addressed in the letter? The position is NOT a permanent position. How can we address this point in the letter? Should we just ignore this point in the letter?

Thanks.

As I mentioned in another post, I'm a postdoc, which usually isn't considered as a permanent position. When I did my I-140 filing, I of course included an employment letter. But that letter is simply a copy of the offer letter given to me by the university at the beginning of each "employment term". So, it was even written in the letter that my current position would end in a few months; though it could be renewed when the current term ended, but it would be subjected to funding availability. To counter this, I mentioned that several US companies were very interested in what I was doing and was considering future possiblities of technology transfer (substantiated by reference letters from the companies). This not only emphasized the potential benefits that I could offer this country, it also indicated the possiblity of my working at another company (i.e. a more "permanent" position) in the same research area that was obviously important for the national interest... This is my story.

I believe the bottom line is, what really matters is what you do to benefit the national interest of this country. I can't say for sure that this issue of nonpermanent position will not cause problem with you petition, but at least in my case it didn't have any obvious effect.
