Please help on H1B Agreement with employer

Dear All,

I joined one company in US last year on H1B. When i landed into US this company asked me to sign one agrrement where i cann't leave comany before 18 months. Agreement says that if i leave company before 18 months i have to pay 10,000. I have just completed one year and changed my job. My employer is threatning me that he will file a legal case against me.

Please explain, can my employer file case against me. Will this agreement be considered legal? Where i can get help.

This is not legal advise.

It's very unlikely that your employer will pursue a legal case against you because such agreements are not binding/legal. This is standard practice for dubious consulting companies.

Ignore them.

First of all, this is NOT an H1 agreement. H1 has nothing to do with your agreed contract between you and your employer.

Your ex-employer can file case, just you can file case against employer. Whether contract is a binding one, depends on lot of factors.

Defending such cases could also cost good amount of money.

I suggest, talk to a good lawyer.
