Please HELP on AP question......

I am on I-485 and my and my family’s H1 is valid till next year. I will be visiting India shortly. Does anyone has any knowledge or has experience as to whether my family needs AP or not. My wife is working on EAD. And even if she needs an AP do my kids also need AP.

I would greatly appreciate guru’s comments.

If I read you correct, you are working on H1B and your wife on EAD and your children on H-4.

When did you file your I-485 (RD). If you expect you approval shortly, it is better to take AP for all of you. Otherwise, you can travel on H1 visa. H-4 visa is good enough for your children. As far as your wife is concerned, since she is on EAD, she would need AP. It is also advisable to take all your original 485 with you.
 
AP for family...

My RD is 09/09/2002 so still there is lot of time to get approval. Suppose I take AP for my wife, than is it necessary to take AP for my kids or their H4 will be valid?

Their H4 visa should be good enough. I have seen many clarifications on this from the INS web site and also in Murthy.com (check murthy.com archieved chat for the last 3/4 weeks)

Signed and completed I-131
$110 check/money order ( check with INS site if the fee is correct)
2 photos (name of person photographed must be written on the back side)
Signed and completed G-28 if you file thru attorney (otherwise ignore)
copy of photo identification (photo page of passport is best)
Copy of birth Certificate
