PLEASE HELP - need some info

Hello all:

I am in serious trouble(may be not), need some help. send me your opinion - whatever you think. I am in a situation where I need to take some decision and go ahead with my life. Its bothering me a lot.

my company will lay-off lot of people by end of this month.And here is my situation:
I filed I-485 in feb'02 and have my EAD in hand. Here are my questions:
1)What if my rfe comes while I get laid -off?Since they are processing jan/feb cases now, chances are high
2)Since my lay-off chances are 50/50 - I dont want to take a chance. I did my homework and got a job already after last month's interview.But they want me to join by mid May.My new salary is lower than my old one. What would you do at this point?I am confused and need some ideas
3)If I switch to new jobs - what I need to do or rather what the new company needs to do?
4)Since my new salary is lower, will it pose any threat to my RFE?Can INS cancel my I-485 because of lower salary?
5)Will it be worth staying back with my company and taking a 50/50 chance?
6)How much time INS gives to reply to RFE?
7)Any link/url/pointer where I can get all related info and make my position solid?

What would you do?

I may be pretty close getting my GC and I am in a situation like this.

Am I paranoid?
 
This is a typical scenario that most of us are going through ..

You have 90 days to reply to the RFE .. And if you have already done your due diligence and quite prepared for interviews, you might want to consider ..

the probability of getting another job in a month .. if the layoff decision were to really go aginst you ..

besides, you are going in for a lower pay ..

the call is ultimately yours .. but, do not think too much about that .. But, one thing you have already proved: You can get a job pretty soon and you are prepared for it .. :)
 
If the new salary meets the LC stated and the new employer agrees to give "good" employment letter, I would take the job.
 
Also, consider if you employer provides good severance package (time in payroll after layoff.. and moneywise too)

You look for another job with a similar job profile, and hopefully get it soon, after which you reply to the RFE.

a. Check if the new job is doing something I really want to do,
b. Since you have your toe in the job market, check if there are any other opportunities that might suit you better.
c. Try getting a better prespective on your current job.
d. If you like the new company and the job profile, switch

As of right now nothing, if you get a RFE, then they might need to give you an EVL (basic HR stuff), and maybe a financial statement attesting to the health of the company (rarely)

No to both questions. AC21 takes care of this, please read my other posts in this regard for more information.

Depends up the job situation and the salary/work you are doing.

Explained above. But in my opinion, all situations are different, and to each his own. You know yourself and your situation best, and are the best person to make a decision. Trust in yourself, and if you want a second opinion, take it from someone who you can trust like your family, father, etc. They will have your best interest at heart and will rarely take a decision to hurt you.

Absolutely not! I think you are extremely lucid and clearly thinking out all your options. I like that in a person. I personally hate having only one plan of action, and prefer to have atleast 2 backups to most scenario's. Your thinking is a classic example of redundency, and having a backup plan ensures that there are rarely unpleasant surprises.

140_takes_4ever: You are awesome!! Very matured response and good to hear that you liked my attitude. I like to take actions rather than waiting for the consequences. Good to know that you are of the same kind. I was looking for your AC21 info - I got 1721 msgs while searching on your name :-) That says how you are helping all of us here.

Can you please let me know where did you explain and discussed AC21 issues? I am still going through all the msgs which hit my search :-)

Infact thats what I meant by url/pointers etc. - where should I look for to get all related info on AC21?

PS: My concern is just the salary part - since its lower than my present one.
