Please Help! Need info on filing I-130

my husband is just about to deploy to iraq, and we were wondering if it's possible to file his I-130 form before he leaves, that way (hopefully) it's approved before he comes home, then i will be able to meet him here to welcome him back:)

also, if he ends up leaving earlier than expected, which i know can happen in the military, would it be possible for me to send the form myself, to get things moving while he's gone? or does it have to be sent from a US address?

i've tried calling immigrations about this, but i can never get through, so if there's anyone on here that can help us, please post.

any help would be much appreciated.

I-130 can be filed in Iraq. That's not a problem. What is your status in the USA, and his?
 
i'm just visiting right now, but he was born in pennsylvania.

would it be possible for me to send the petition from canada, once he leaves? with him going to iraq, i want to help alleviate him of any issues that might be easily done from here.
 
Do you both have an income required? Then submit 130, 131, 325a, 485, 693, 765, 864 forms together in one envelope to the I-465 address. If he sends just I-130 it won't let you meet him here to welcome him back.

what the hell? why would we need to send 6 other forms along with the I-130? we were told I-130 is the petition form, then there are others that are to be sent off after the petition is accepted. what are these others, and will they end up costing us an arm and a leg? if each one has a separate price then there's no way we'll be able to afford it before my husband leaves:'(
 
Yes, you right, welcome to the hell. You need to demostrate that much http://www.uscis.gov/files/form/I-864P.pdf of the income or assets otherwise you are not eligible for filing and the fees are about $2k. You still can wait illegally for him, if you not going to travel abroad.

He needs to sign 130, 325a, 864. And you can send them in as needed.

That is partially true. The I-130 can be sent in by itself, followed by sending in other forms after the I-130 is approved. But less than 10 years ago they changed the rules to provide the option of sending in the other forms at the same time with the I-130, thus cutting down the total time for end-to-end processing. If the I-130 is filed by itself, that doesn't provide you with any authorization to stay or work in the US after your visa expires.

Do you plan to wait in the US while the forms are processed? Or do you intend to return to Canada to complete the processing at a consulate there? The choice you take determines which forms you need to file.

If you do the processing in the US, both of you would have to show up for the interview, which may be impossible if he is tied up in Iraq. Unless there is an exception they make for military personnel in active duty, allowing you to interview alone. If you interview at a consulate in Canada, you would interview alone.

jackolantern, it is alright to send in just the I-130 form to start off with? my husband should only be in iraq for about 10 months, and we were told that the petition alone will take at least 6 months, so he asked me to send it off a few months after he leaves, so when he comes home we would be able to meet up in the US.

after that, we would be doing the rest from there. i know i can't work without a visa, but that's why i'm working now. to build up my account so i can help with finances for a while when we're together.

if we can send off just the I-130 form to start with, i can pay for that myself, then my husband said he would help pay for the rest of the forms when he's home, since he'll be making more money while away.
 
I-130 won't let you stay in the country legally, further more you might have issues entering as a visitor. File separately only if you are going to do a CP.
 
i was told by several people from immigrations that the I-130 form was so i could stay in the country legally. did they lie, or have the rules changed recently?
