Hi everyone :

Here is my situation,

I have an AP which is valid till SEP 24 2003. I am planning to travel to India on OCT 24 2003, since I have my sister's wedding. I also have an approved H1 which is valid till Jan 2004, not yet stamped in my passport. ( 8th year extention )

1. Can I get my H1 stamping in India ?
2. I have also applied for my 2nd AP, is there a possibility that I may get that AP before OCT 24 ?

Please advice.

1. You can H1B in India but these it's a very lengthy process.
2. If you don't get AP after 60 days(from receipt date) then you can get emergeny advance parole from local BCIS office.

What!?? Are you 100% sure about it? You know anyone who got emergency AP that way? I thought emergency AP is for situations when your relative died or is in critical situation, but that has nothing to do with your regular AP application. As a downside, you have to have convincing evidence of emergency and you have to go to CSC in Laguna Niguel.

Edison, where did you read that thing about AP in local BCIS office?

Yes. Check with your attorney. There is something known as interim AP. Usually, you can walk into your local INS office and get an AP the very same day. Good luck.

Can you shed more light on this interim AP?? My attorney said there is nothing like that in AP. There is only interim EAD after 90 days of application.

Did you get an interim AP? OR Do you know nayone firsthand who got interim AP??

Same day AP

Yup, believe it or not, you do get AP the same day at your local BCIS office.

I know of atleast two of my friends who got emergency AP. I don't know the details of what questions were asked, but I do know that they both had family emergencies.

If you did apply for your AP at your service center, but did not receive it in time, you could go to the local BCIS office after 60 days or so and apply for one again. They will issue you a new AP valid for one year from the date of issue, the same day.
