Please Help my friend

Sorry to post this here but this is the only forum I visit and I know that there r exceptional people here..Here is my friends' situation..

His dad passed away a week ago. His 485 is under process (Filed sometime in 2002/2003)he is the sole care-taker for his mother (no other kids) and his mom has some health problems also, is it possible to bring her here where she can be brought on a more permamnet thing than the visitor's visa ? DO you kow of anybody
else in this situation and has been through it before ? Where else can we go find out some funda about this ?


Any information will be appreciated...
 
There is one solution at the moment :-

Apply for visitor visa and come here. Generally they let you stay for six months.

If she is lucky she might get multiple entry visa for 10 years.

That implies she can go out and come back after six months.

A lot of people do it.

There is no other legal solution possible
 
Or renew after 6 months...

Bring her on visitors' visa for 6 months, then extend for a year. Then she needs to go back for some time to India. And then repeat the process above till your friend gets GC and Citizenship and then apply for her GC as parent of a citizen...... and she gets her GC to stay here permanently...

One more question - has anyone here extended their parents vistors visa after the initial 6 month stamped period has ended.

If so , have they gone again for Visa stamping back in their native
country for say 2nd trip?

I have heard that if you have extended your stay on visitors visa,
they hold that against you when you got for visa the next time.
 
You will have trouble if you extend your visa in the States! My in-laws have come to the States three times before this time. They extended their visa two of the previous three times. When they applied the visa this time, the officer warned them NOT to extend, otherwise they will be NEVER allowed to come to the States again. Before 9/11 it's normal to extend the temp visa to one year and perfectly legal, now they also treat this as breaking rules although it's still perfectly legal! (what can you say? We all know who are the real rule-breaker actually).
 
I have friends who extended their parents' stay for almost 3years due to medical reasons..his dad passed away here during the stay..his mom is currently in india and hoping to come back soon..i wonder what would the officer think in those situations..

ok..from all the posts above..as i thought, there is no other way to bring her here other than visitor visa..i will just tell him that and maybe ask a lawyer abt medical reason...

Set her up as a Dependent.

If he can convince a Judge from the Circuit Court to declare his mother as a Dependent, then he could probably include her as a dependent on his 485. I don't think anyone has done this so far for their parents. Though I know of a friend of mine who did this for his nephew.

But it is easier for the Judge to declare a 5 year old as a dependent than a 60 year old. I know it is a long shot, but its worth a try. Your friend definitely needs to get in touch with an attorney.
 
I believe u might be right...i will tell him that..that's a viable option..hey..i even included my parents as dependents while filing taxes while i was on h1b...none noticed..not that this thing is related..but this might be a good option..but i think she should come here thru visitor visa first...
