Please Help Me With My RFE (Part 2)

I do not wanted to create the new thread again. But I am compelled to do so.
I got the second RFE details.

RFE for me includes:

1. Last entry to US prior to filing I-485. I went to Canada. And while entering to US, they do not stamp your passport. So, I do not know what should I do other than ask lawyer.
2. Clarification on mother’s name. Her first name before marriage is different than after marriage. And my parents do not have marriage certificate. They are asking explanation about it.

3. Submit statement indicating name and location of your current empoyer including the date you began employment with the organization.
Easy

RFE for my husband includes:

4. Clarification on mother’s name. Her first name before marriage is different than after marriage. And his parents also do not have marriage certificate.

5. As you were married to principal applicant less than 2 years of filing the I-485, submit the evidence for valid marital relationship. Easy

6. Photo ID clearly.Easy


At this point I do not know how to react.

In my response to RFE 1 I provided Affidavit's from my parents. Fortunately they are visiting me in US.
Not heard from USCIS yet.
 
Hi Mugdha,

Point 1 in RFE is scary...I have the same situation (used road crossing to go to Vancouver). Please let me know how you deal with this. Mine is a very recent (04) case.

Re: 1 - Canada Trip - Do you have copies your ticket? IF yes, then send the copies and let uscis know that border people did not stamp your passport. This is standard practice at border.
Call the Canada/America border immigration officer and ask them about your situation. They will help you.
 
Actually, I went to Canada via ferry and came back to US driving. I do have a stamp on my passport when I left US i.e entered Canada via ferry.

But I do not have a stamp while entering into US as we drove back. we cross the border at Blaine, washington. They did not stamp my passport neither issued I-94.

Stayed with the friends at canada.

How do I prove my entry to US?

Mugdha and rest,

I think I read somewhere in this forum that in those cases there is a need for an afidavit. They know that if you come from Canda, you will not get stamped as they established the rule, But it is my understanding that they are checking your passport (they did mine coming from the embassador bridge in MI), and clicked a couple of things on their system. I am not sure what was it, but you never know. Does anybody with this kind of experience can shed some light?

Thats what my attorney also said, some kind of affidavit would be required. I know that at Blaine, WA crossing there's definitely no data entered from PP etc., ie, they take a quick look at PP and maybe ask a qn and thats it..
I will ask my attorney again and post what he says.

Yeah, that will be great. I have also asked my attorney. I am hoping to get answer today. I will post it as soon as I get it.

Others, if you read something about this please please give us all the information.

I too had no stamp on my passport upon driving to US from canada through buffalo. My attorney made me write an affidavit stating my purpose and duration of visit to canada. he also made me put together receipts from restaurants and gas stations from either side of the border to prove that I was where I said I was. also mention in the affidavit that it is not common for border customs officers to stamp the passport.

When the FedEx package (RFE reply to be specific) is delivered to the USCIS, does it required to be hand delivered by Fed-ex person?

My FedEx package status says "Left at back door. No signature required - release waiver on file”

Is this normal?

Hi,

I do not have personal exprerience about this but I think the FEDEX person that delivers the packages to USCIS center would know what to do with the package. As it is usually the same person who does the rounds every day. He /She must be delivering dozens of packages to the USCIS office every day, I think you should not worry as he would be well versed with the routine.

Mugdha. When my lawyer responded to my RFE they also used FEDEX. I asked the paralegal and she said that the reason is so that it can be tracked once USCIS picks it up. So my advice is that you should not worry about how it is delivered to USCIS. Let your attorney handle that part.

In a few days you should most probably see a change in LUD for your case. If that happens then it confirms that USCIS received your RFE. So just relax and take it easy for probably a week. You are almost there.:)

USCIS received my reply on october 13, 2003. Today, I have another LUD on both of our (my case & my husnad's) cases.

I told you so. :) Now keep fingers crossed that this LUD keeps changing for the next 3-4 business days. If that happens then most probly you will get approval email. The same thing happened in my case and LUD started changing 3-4 days and then I got that magic email one fine afternoon.

Update

When are u expecting you 485 approval?

I submitted my RFE 9/28 LUD changed few times but nothing so far.

My colleague at work who filed after me already rec'd her 485 approved. She was 8/2002 RD.

Last time it happened that after 17 sept, 04 there was no LUD change on my I-485 case. Later, I got another RFE on 28th.
This time, I am expecting that I will get approval either today(less chances as it is already after 4 pm) or by monday. My case has been so unpredicable that I can't think logically now.

Another very strange thing I saw today is, my husband's LUD is changed today but not mine......I am primay applicant.
Isn't it strange? The only thing different is my FPs are current and his is not.

I hope they won't hold my approval till his FPs are current....God knows...

In your case, I think you will get approval soon.

Seattle - Burien office.

Hi Guys,

My husband (derivative) got FP notice last friday evening 15 Oct, 04. The address on the notice was "125000 TUKWILA INTERNATIONAL BLVD., Seattle, WA 98168" which is where the seattle CIS office is going to move. But on this forum itself, I read about the start date of this new office to be 17 Oct,2004. So, we thought instead of waiting for 2 more days, let's try going Burien office where my last two fingure prints were done. So we went to Burien on saturday at 8.15 am. My husband's schedule date was 25Oct,2004. We asked the guard if he can take his FP here today. And he just looked at the notice and he let my husband in.

When my husband was taking the his fingure prints, the immigration officer there told him that the new office (125000 TUKWILA INTERNATIONAL BLVD., Seattle, WA 98168) won't be functional for taking FP till end of this month. He was surprised to see the new address on the notice and schedule date before Nov 1,2004.

I hope this information is helpful to people who want to get there FP before 1rst Nov, 2004.
