please help me with citizenship case

well this is my story. I applied for N400 in dec 2005. I have been married to a US citizen whos a member of the military, for 4 years and also have been a permanant resident for more than 3 yrs. i was scheduled for an interview aug 2006 which has been cancelled due to unforseen circumstances.I havent been rescheduled since. i want to know if i can sue with writ of mandamus. i have passed the 365 mark now and been waiting for 1.5 yrs. i have not had an interview yet. can i still sue? can anyone provide me a sample or the links. i have seen alot for with an interview but not for one without an interview. also will i have to go to court?
i have contacted the obudsman, congressman and the service center with no avail. Please help me any help will be appreciated.

Do you know for sure that it is "name check"? If it is, I believe there isn't much you can do. If it is something else, then there are more options.

Background check doesn't necessarily means that the name check is pending and it has not been cleared. Just to give you an example, I went to the local immigration office in Atlanta yesterday (InfoPass process) and I was told that my case is still pending, waiting for the interview as the background check is still pending. Keep in mind that my FP & NC have already been cleared. Flydog could add to this. Question for Flydog......since my NC & FP are cleared and the case is still pending for my interview. Do I stand a good chance for WOM ?
