I have obtained J-1 waiver based on exceptional hardship. Based on this my employer's attorney had filed for an H-1 B petition on my behalf . This petition has now been approved with a start date of October 1st 2007.
Since at the time of my signing the contact we not not sure as to the outcome of the exceptional hardship case . My employer's attorney had also filed for a conrad -30 waiver.
Now my employers attorney is also trying to get the conrad -30 case adjudicated so as to enable an earlier start date. There reasoning is that in case the conrad -30 goes through they would withdraw the previously approved h-1B petition derived through hardship and file a new one with a earlier start date based on the conrad -30.
My question's are
1) is there any risk involved this process?
2) Supposing I end up going on the H-1B derived through the conrad waiver and then do not like my job and quit after 1year . Would a new employer be able to file for a new H-1B on my behalf based on my orignally obtained hardship waiver???
