**Please Help me: LC (Traditional EB3) -->PERM

hi, Folks,

My LC was filed as traditional in March 2003(California). I am thinking change it to Perm. Would you please kindly help me figure out some questions?

First, may I transfer it to PERM but keep my Priority Day if no change on job description, job title, job location etc.?

Second, if I have to refile as PERM, which means lose my Prority Day, is it possible to change it to EB2(assuming I can change the job requirement)?

third, if I just keep the current LC application, can I change it to EB2?

Last and the most important, I understand if I application GC in EB3, I need a priority day to wait in line. It is the same date I applied LC, which is March 2003? Or it is the date I received LC?

Thank you guys so much. Your answer will help me a lot.

Yes

I think this should be possible. It's just a fresh application. Make sure you received all qualifications required for this job (and EB2) before you joined the job.

Yes, your PD would be 3/2003

the LC application really bother me. I am trying to find a way to improve my situation. Even a little bit will be helpful

You can try for a preapproved labor your company may have.
Maybe they will be more cooperative as it was the lawyer's mistake.
With preapproved labor, you get PD of the original application.

Also, there has been some legislation (one passed senate, waiting on house) to ease retrogression. Also, there's talk that 100k unused visas from 2000 days being made available.
