Hi guys,

I have aquestion about H1b. I recently came on H1b from India. I have a contract with them which says comapny has spent $$$$ amount on me and I have to stay with tehm for 48 months else pay them $33 thousnad.
He did not spend a single penny on me. I agree that I was dumb and deaf abotu all the H1 B process being ignorant I paid the attorneys as well as the H1B fees. about $7000(that is what he told is the total H1b expenses which is a lie and I came to know only after I came to US)
After comminh here he didnot put me on job. Somehow one of my friend helped me and I was able to transfer my H1 visa to friends company. Now my Ex employer is back of me he is abusing and scaring that he will rovoke my visa, he will complain about me stuff like thta.
I want ot know what will be the consequnces of all these. IF he comes to know about my transfer can he sue me? I think he knows my SSN can he find out if I have trnsfered an dworking for difeerent company? i am in big trouble

I am sorry to hear your case. But your employer ( or whatelse you can call him) is a bitch.

I don't think what he can do about it, Now that you have a new visa with a new company. You can always sit back and relax and forget the old company as a bad dream.

Let the old company do the chasing.
 
He can't do shit to you

I did the same thing and was threatened with law suits, reporting to INS etc. The truth he can't do shit to you. On the other hand you can sue him for not paying you the stated rate in the LCA and for enforcing a contract on you which is illegal in the US. My friend also in same state threated legal action and the company settled mutually by paying him $ 12, 000 for 4 months of bench.

Just send him a note saying that you contacted an attorney and he is contemplating legal action against him for harressment and non payment of past dues. He has to pay you the full amount even if you were on bench.

These sort of contracts could be worth, once taken to court. But 48 months seem a little longer, look at what are the exit criterias in the contract. All contract should have exit criteria. Do a weigh- in situation of how much he spent on you and how much you owe him. And do you have documents that you have paid for your own H1B?

If you were not paid, it is very necessary , you report that to the labor department. Otherwise, you could be blamed for out of status.

I think, this cannot be considered as harrasement unless you claim that you were not being paid, and forced to stay in the company, which could not offer you the promised offer.

First , talk to your employer explaining him things, most situations are solvable once you talk to them .
