Hi guys,

I have aquestion about H1b. I recently came on H1b from India. I have a contract with them which says comapny has spent $$$$ amount on me and I have to stay with tehm for 48 months else pay them $33 thousnad.
He did not spend a single penny on me. I agree that I was dumb and deaf abotu all the H1 B process being ignorant I paid the attorneys as well as the H1B fees. about $7000(that is what he told is the total H1b expenses which is a lie and I came to know only after I came to US)
After comminh here he didnot put me on job. Somehow one of my friend helped me and I was able to transfer my H1 visa to friends company. Now my Ex employer is back of me he is abusing and scaring that he will rovoke my visa, he will complain about me stuff like thta.
I want ot know what will be the consequnces of all these. IF he comes to know about my transfer can he sue me? I think he knows my SSN can he find out if I have trnsfered an dworking for difeerent company? i am in big trouble

If you have signed the contract then your former employer can sue you.

I think its better for you to try to settle down matter peacfully.
 
I am a layman in this, but I understand that the employment is at will. Neither they can force you to work, nor they have any binding to keep you employed.

As far as contract is concerned, they sure can sue you. But then you should fight the case and you can say that they didn't place you to a project, and they didn't pay you any money after employing you. Hence they didn't fulfill their commitment and you had no option but to leave the job.

I suggest, you consult a lawyer, as he can tell you a better way out after having a look at your contract.

I guess, they can't really create you any harm. Also with your SSN they can't come to know of your employment status.
Now since you got H1 transferred, even if they revoke your old H1, it doesn't matter.
 
Don't worry as your ex-employer cant do any bad even you signed some contract with them. H1B laws are in favour of worker not employer. As they never paid you since you came to US on their H1, you better call them that you need to be paid for your salary since you came to US and also ask them to provide you a one way ticket back to India and the expenses you paid out of your pocket for paying INS fee and Lawyer fee.
Tell them that if they dont pay you all this you will going to complaint against them with DOL.
Just send your emplyer an email stating all above and see the results.
