Please help me, I have 2 questions about AS GC.

1. My father is AS6 GC holder, he's been in the US for 8 years, never went back to COP - China. But recently my grandma is sick, and he can't wait for his citizenship to go back to visit my grandma. I'm afraid that he might have problems when coming back, problems from both sides, China and the US. Am I right? In case, if he get any problems when enter US, or if his GC is taken away, will my mom and I be affected? I mean will US goverment take away my mom's and my GC also?

2. My girlfriend, who is in China, wants to come to the US, I'm a AS8 GC holder, what's the best and fast way to apply for her? Get married with her in China first? Or wait for my citizenship first? Any suggestion?

1. It will have no affect to your GC and if he can exit out of China without trouble, the U.S immigration won't give him troubles. Just make sure that you have the evidence of his visit just in case it is asked or when it is asked during USC interview. lot of ppl frown on COP visit but if you have valid reason, I think it is ok.

2. If your GF can't come any other way..i.e, H1 or a student visa, then its better you marry her. The wait time for GC spouse is 6-7 years and in those years, she can't visit you. If you know this is the girl you want to be with forever and wait time is not a problem for you, marry her and file her I-130. You never know when the law can change..maybe next year with a new president.

Tmitim: If you are AS8, your greencard and your underlying grant of asylum are dependent on your fathers’ case. If your father runs into trouble with the USCIS in any way, it is gonna affect you when it comes to applying for your citizenship. USCIS may not come to your house and take away your greencard, but when you apply for citizenship, your fathers’ case may come up and might be bases for denial of citizenship application.

As far as petitioning for your girlfriend goes, you will have to check with someone with experience. AS8 category is a special case, and as it is a derivative case from AS6, it might not be possible for another person to derive another status.

How can I apply for her for H1 visa? In fact, I have a non-profit corporation, helping new immigrants and new international students. It's newly opened, can I apply H1 for her?
 
I think I will get my citizenship in Feb 2010. Then I apply for her visit, how long will it take in that case?
