Please help me for reply the RFE

Hello Guys,

I really need your kind help. As I mentioned before, I got generic RFE after PP my EB1a about 10 days ago. They listed the 10 criteria. The strange thing is the description is a little different from those 10 criteria listed in the I-140 form. For example, there is no “authorship”, instead, there are two similar criteria: (1) ( as applicable) evidence of commercial successes of your performances in terms of monetary receipts; (2) Evidence of commercial success in the performing arts. Another criteria is “evidence that the events in which you performed have a distinguished reputation”, which I guess is corresponding to “Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation”, as listed in the I-140 form; In addition, they also requested for evidence that “you will continue to perform work in your field in the United States”, and evidence for that my entry into the United States will substantially benefit prospectively the United States. I basically submitted all the evidences and addressed all the questions in my original petition.

I would like to ask for your opinions on this RFE, especially on the following issues:

(1) I’m going to revise my cover letter, should I resubmit all the supporting materials (maybe re-organize them)?

(2) Should I provide several more support letters? Can I submit another letter from person who already wrote a support letter for my original petition?

(3) In the letter, they mentioned that “the submitted translations are not certified. Please submit certified translations of the foreign language documentary evidence submitted”. Do I have to translate ALL the words in foreign language and get All of them certified by other people? Can I certify it by myself or my wife?

(4) As to that “Evidence that you have served as a judge of the work of others in your field”, I didn’t judge others’ work as a journal reviewer, just published some review papers in foreign language, I only put a short paragraph for this in my original petition, should I just don’t “touch” this criteria?

(5) Same thing happened to “Evidence that you have commanded a high salary or other remuneration of others who perform your work”, I don’t think my current salary is much higher than others, should I bypass it too?

(6) Since I don’t have “published materials about me”, I collected a lot of online information, such as the professional databases which cited my papers, is it OK? Can I use the ISI paper citation, which I used for the “major contribution”, for this criteria?

Only thing I can tell you that it is not a good idea to submit different letter from same author. It suggests that you have drafted the letter and he signed it.
 
I would suggest that you do not send the same documents again. It may lead to the examiner believe that it is the same thing again. Send additional recommendation letters, presentations or anything that you did not send earlier. Also reformat the cover letter. I would also think about getting an attorney to respond to the RFE.
 
The problem is I have already submitted all the supporting materials. I don't think I can dig more supporting materials, except for several letters. Guys, how did you handle this? And also, how did you certify the translated documents? It's too much to certify everything by a notary.
